Federal judge ruled against X over unpaid bonuses to employees

Over a year after Elon Musk could take over X (formerly known as Twitter), the company still faces lawsuits from former employees and contractors. X was first sued over mass layoffs and unpaid bills. Now, the company is facing another lawsuit over failing to pay bonuses to its employees.

According to Reuters, a federal judge ruled on Friday that X violated contracts by not paying the promised bonuses. The lawsuit against X Corp was filed by the company’s former senior director of compensation, Mark Schobinger, in June. Schobinger left X in May.

The U.S. District Judge Vince Chhabria said Schobinger’s breach of contract claim is based on California law. Schobinger added that Twitter promised to pay 50% of their 2022 target bonuses but never did so before and after Musk’s takeover. “Once Schobinger did what Twitter asked, Twitter’s offer to pay him a bonus in return became a binding contract under California law. And by allegedly refusing to pay Schobinger his promised bonus, Twitter violated that contract,” the judge noted.

X fails to pay promised bonuses to its employees, resulting in a lawsuit against the company

After X’s motion to dismiss the case was denied, the company claimed it had an oral promise with the employees over the bonuses, and there was no official contract between them. Additionally, X wants the case to be governed according to Texas law. However, the judge failed X by choosing the California law and adding that “Twitter’s contrary arguments all fail.” X has not yet responded to the requests for comment.

Since Elon Musk’s takeover in October 2022, X has faced multiple lawsuits from former employees over non-compliance with the terms of the contract and discrimination against women and staff with disabilities. X was even sued by its landlord over not paying the rent. As expected, the company denied all the allegations.

Above all, X is now under fire over mishandling the Israel and Hamas war. The European Union alleges that X deliberately allows misinformation to spread and fails to protect users. The strictures of the E.U. have reportedly made Elon Musk think of blocking the platform on this continent.

Regulators worldwide have become more sensitive to the business practices of tech firms and social platforms. Every once in a while, we hear about a multi-million dollar lawsuit against a tech firm in a country outside of the U.S. In a recent case, Meta faced a €5.85 million ($6.45 million) lawsuit in Italy over breaching gambling advertising rules.

Samsung postponed mass production at Texas chip plant to 2025

Samsung is pushing back the production of advanced semiconductor chips at its new plant in Taylor, Texas. According to the Korean media, mass production at the factory will begin in 2025. The company originally planned to start churning out chips from this facility in the second half of 2024.

Samsung’s new chip plant in Texas may not be operational before 2025

In November 2021, Samsung announced a $17 billion investment to set up a new semiconductor factory in Taylor. It would be the company’s second chip plant in the US. The other factory is located in Austin, Texas, and has been operational since 1996. Industry insiders reported earlier this year that the new factory may end up costing Samsung $25 billion, over $8 billion more than the initial estimate.

Despite the added cost, the firm appeared on track to finish construction at the site by the end of 2023 and start operations next year. Unfortunately, the latest word is that the plan has been delayed. The new plant may not be operational until sometime in 2025, Bloomberg reports citing information from the Seoul Economic Daily. Samsung Foundry President Choi Siyoung reportedly broke the news at a recent industry event in San Francisco.

The Samsung executive didn’t share a precise timeline regarding the mass production plans at the new Texas chip plant. However, even if the production begins in early 2025, we are staring at a few months of delay. The cause of the delay is not known, though. There have been reports that the company is looking to construct a new building at the site to expand its production capacity amid an exponential rise in demand for AI chips.

TSMC has also postponed production at its new factory in Arizona

Samsung isn’t the only semiconductor foundry building a new factory in the US. Taiwanese firm TSMC, which holds a lion’s share in the global foundry market, is also constructing a chip plant in Phoenix, Arizona. It originally planned to start producing 4nm chips at the factory in 2024. However, the plan has been postponed until 2025. TSMC said this delay is due to a shortage of skilled workers with the necessary experience in installing semiconductor equipment.

These delays are a huge blow to US President Joe Biden’s plan to create a robust semiconductor supply chain in the country. The long-term plan is to establish self-sufficiency to avoid supply disruptions in the future. An unprecedented global chip shortage in 2021 cost American companies hundreds of billions in revenue. Biden wants the US tech industry to be prepared for such adversities in the years to come.

However, his government hasn’t quite delivered on promises of financial support to foreign companies expanding their chip production capacity in the US. Biden signed the Chips Act into law over a year ago, pledging an incentive of over $100 billion for participating companies. However, his government has reportedly only awarded a single grant so far—$35 million to British aerospace firm BAE Systems. Whether we see more activities after next year’s US presidential election, time will tell.

The OnePlus 12R will be its name globally, and the OnePlus Ace 3 in China. The thing is, the Sand Gold color shown above will be exclusive to China. The other two will launch globally, the Star Black and Moon Sea Blue.

Speaking of which, OnePlus also shared some new renders of the OnePlus 12R in all colors. Well, in all honesty, this is also the OnePlus Ace 3, but considering that the OnePlus 12R will look the same… it’s the same thing. Those pictures are included in the gallery below.

Once again, you can ignore the Sand Gold color, if you don’t live in China. The other two colors will launch globally, based on the teasers that leaked out recently. OnePlus could still surprise us, though, of course.

The OnePlus 12R will be inferior to the OnePlus 12, but it will still be quite powerful. That will be the first OnePlus R series device to launch outside of India, actually.

Apple holds talks with major publishers to train its generative AI

If there’s one phrase we kept hearing throughout the year, it’s AI (artificial intelligence). The fire ignited by OpenAI’s ChatGPT has created a whole new niche among tech majors. Exactly, that’s when Tim Cook hinted about its interest in generative AI. Cupertino major was long speculated of working on this project for years, but now it is confirmed. Altogether, Apple’s R&D budget also soared to a whopping $23 billion annually. And now, more details are coming to support the previous information.

Apple approached news publishers to train its AI model

The New York Times reported Apple is approaching several major publishers and news organizations to hold talks, citing people familiar with the matter. Apple wants to use the published content to train its generative AI systems for about $50 million. It has contacted key publishers like Condé, NBC News, and IAC. For reference, Condé owns Voge and The New Yorker; and IAC owns People, The Daily Beast, Investopedia, and Brides, among others.

Although Apple lagged in the generative AI race, but it earned trust by seeking permission and offering payments for data. It has long debated using internet data due to privacy concerns, unlike competitors accused of scraping content. More importantly, OpenAI faced lawsuits from novelists and nonfiction authors, including George R.R. Martin and John Grisham, who claim their works were used without consent to build a multi-billion-dollar business. It looks like Apple’s cautious approach, though slower, prioritizes ethical data acquisition.

Nevertheless, the war on AI chatbots is real with more and more data being fed to train the systems. Big techs like Meta, Google, OpenAI, etc. have already come up with their chatbots and implemented the same in their products. Every day, it becomes more fascinating to watch each competitor strive to outdo the others.

Chameleon Android malware can bypass fingerprint, face unlock

Security researchers have discovered a new variant of the Chameleon Android malware, a banking trojan circulating since early 2023. The latest variant comes with additional functionalities that can do more damage to a victim. The malware also employs new tactics to avoid detection.

Chameleon Android malware re-emerges with new capabilities

The Chameleon Android malware was first spotted in January this year. As reported by cybersecurity firm Threat Fabric, the trojan targeted users in Australia and Poland. It impersonated Australian government agencies, banks, and the CoinSpot cryptocurrency exchange to trick unsuspecting users. Once active in a compromised device, the malware could perform keylogging, overlay injection, cookie theft, and SMS theft, among other things.

The firm anticipated a more powerful variant of the trojan and it has now emerged. The new version has already been seen in action in Italy and the UK. The malicious minds behind the malware are distributing it via the Zombinder service posing as Google Chrome. The service attaches the malware to genuine Android apps so cleanly that it can even bypass Google Protect alerts and antivirus software.

The app in question also offers the same functions as the original, malware-free version. This means users have no reason to suspect anything wrong with their app. However, behind the scenes, the trojan can execute several malicious functions that can cause severe damage to them. With its new capabilities, the damage can be more hurtful than what the original variant of the Chameleon Android malware could do.

The cybersecurity firm reports that the trojan can dynamically respond to the OS version of the device. On devices running Android 13 and later, which have stricter app permissions, it displays an HTML page and prompts users to enable the Accessibility service. Effectively, it bypasses the system restrictions to gain additional privileges that it abuses to steal information displayed on the screen.

It can also bypass biometric authentication

The other new feature of the updated Chameleon malware is the ability to bypass biometric prompts. It leverages Accessibility services to force users to a PIN, pattern, or password authentication. Since biometrics such as fingerprint and face unlocking aren’t accessible to attackers, this tactic enables them to steal a user’s PIN, pattern, or password through keylogging. They can then remotely unlock the device at any time and perform malicious activities.

The new Chameleon variant can also perform task scheduling using the AlarmManager API. While task scheduling is common among trojans, this particular variant has a dynamic approach to it. The Chameleon Android malware can detect whether Accessibility is enabled or disabled and adapt accordingly. These features allow the malware to determine the best moment for initiating overlay or injection activity.

“These enhancements elevate the sophistication and adaptability of the new Chameleon variant, making it a more potent threat in the ever-evolving landscape of mobile banking trojans,” ThreatFabric security experts warn. The best way to keep malware at bay is by avoiding installing apps (APK files) from unknown sources. You should always download apps from trusted platforms such as the Google Play Store.

Waymo driverless cars reportedly outperformed humans

Autonomous and driverless cars are the newest trends in the automotive industry. Tech companies are currently at the forefront of developing driverless cars, followed by car manufacturers and other startups. Among others, Waymo is known to be a leading company in this space that started in 2009 as Google Self-Driving Car Project.

The Alphabet-owned company has published a report on its driverless cars, stating that the tech could “significantly” outperform humans. According to the company’s statement, Waymo completed over 700,000 ride-hailing trips with public riders in 2023 and achieved over 7 million rider-only miles in Phoenix, San Francisco, and Los Angeles.

The research further notes that Waymo Driver performance “led to a significant reduction in the rates of police-reported and injury-causing crashes compared to human drivers” in the cities where the company operated.

Waymo claims its driverless car tech is safer than human driving

One of the metrics that Waymo compares its tech with human driving is the number of vehicle crashes per mile of driving. Waymo’s data comes from “over 7.14 million fully autonomous miles driven 24/7 through the end of October 2023” and the crash reports under the NHTSA’s Standing General Order (SGO).

The data suggests that Waymo Driver led to an 85% reduction or 6.8 times lower crash rate involving any injury, from minor to severe and fatal cases. Additionally, the tech resulted in a 57% reduction or 2.3 times lower police-reported crash rate.

To clarify these numbers better, the Waymo driverless cars tech led to an estimated 17 fewer injuries and 20 fewer police-reported crashes in over 7.1 million miles of driving across Phoenix, San Francisco, and Los Angeles.

This is a significant achievement for Waymo, considering that over 1.3 million people die annually in car accidents worldwide (via Forbes), and in 2021 alone, over 6,102,936 police-reported vehicle accidents occurred in the United States.

Waymo has also published detailed research that compares the company’s rider-only crash data to human benchmarks at 7.1 million miles. The Alphabet-backed company wants to set an international standard for valid analysis of autonomous vehicle (AV) crash data.

Most major product launches take place before the Mobile World Congress officially starts. By that logic, the Xiaomi 14 could launch on February 25, rather than February 27. That’s also what 91mobiles believes, despite Yogesh’s tip. So… we’ll see.

Now, the tipster did refer to this launch as the Xiaomi 14 launch, not the Xiaomi 14 series launch. The question remains whether both the Xiaomi 14 and Xiaomi 14 Pro will launch, or only the Xiaomi 14.

The Xiaomi 14 Pro might not launch globally… even though it probably will

A recent report actually said that Xiaomi is not developing the Xiaomi 14 Pro global software. That hinted at the possibility that the phone will not launch globally. Well, there’s always a chance that the tipster looked in the wrong place.

It’s actually unrealistic not to expect the Xiaomi 14 Pro to arrive. If the Xiaomi 14 Ultra arrived at the same time, then sure, the Xiaomi 14 Pro omission would be easier to swallow. The way things are, however, that’s unlikely.

The Xiaomi 14 is expected to launch globally both in Barcelona and in India at the same time, basically. That probably means the same day, if not the same time literally.

Both the Xiaomi 14 and Xiaomi 14 Pro have already launched in China, so we know what to expect from them. The Xiaomi 14 Ultra is also expected, but that device could arrive at a later date, in early Q2 2024, or something like that. There is still a chance Xiaomi will flip things around, and launch the ‘Ultra’ model in Barcelona as well.
